The court held that claims of invention reciting a dentifrice, a chewing gum, or a method for reducing enamel solubility through use of distannous chelate of ethylenediaminetetraacetic acid are ‘useful’ within statute authorizing issuance of a patent to whoever invents or discovers a new and useful process or any new and useful improvement thereof, but claims of invention reciting either the defened genus or species other than the distannous chelate of ethylenediaminetetraacetic acid are not ‘useful’ and are not patentable.
